Accordingly, this Decree prescribes the management and use of non-refundable aid, which is not categorized to the official development assistance of foreign agencies, organizations, and individuals for legally established agencies and organizations in Vietnam for socio-economic development, humanitarian assistance, for non-profit or trade-free purposes.

Regulated entities of the Decree are agencies, organizations, and individuals participating in or related to the management and use of non-refundable aid, which is not categorized to official development assistance.

Aid providers are foreign organizations and individuals that are well-intentioned, respectful, and abide by Vietnamese laws such as foreign non-governmental organizations, non-profit organizations, social funds, private funds established under foreign laws; foreign individuals, including Vietnamese residing abroad, etc.

Recipients of aid are Vietnamese agencies and organizations established under Vietnamese laws with functions, tasks, and activities suitable for the objectives and contents of the aid package.

The management and use of aid are required to comply with Vietnamese law. The aids shall be received, implemented, and used only after having been approved by Vietnamese competent authorities. The aid must come from lawful sources of money and assets.

Regarding the competence to approve aid amounts, Article 7 (Chapter II) of the Decree clearly states that the Prime Minister approves aids related to security, defense, religion, and those that directly support the development of legal documents. Under relevant laws, the Prime Minister also decides on imported goods.

The Decree also stipulates aid implementation management, financial management, state management regarding aid and enforcement provisions.

This Decree takes effect from September 17, 2020, replacing the Government's Decree No. 93/2009/ND-CP dated October 22, 2009, promulgating the Regulation on management and use of foreign non-governmental aid. Specific information can be found here.
