1.1 Implementation order

- Step 1: Individuals and organizations submit fully and valid dossiers at request-receiving and result-notifying sections -Bac Giang Industrial Zones Authority:

+ Time of reception: The morning from 7h30 to 11h00, the afternoon from 14h00 to 16h00, from Monday to Friday weekly.

+ Form of reception: The dossier-receiving and result-processing agency's staff shall check dossiers, if the dossiers are sufficient as prescribed, the dossier receipts (with the date of appointment) shall be handed over to the organizations. Provide additional guidance if the application is incomplete as required. - Step 2:

+ The dossier receiving and returning result-receiving sections shall be transferred to the labor management sections according to regulations.

+ The Labor Management Department shall organize the inspection and consultancy on appraisal opinions on the dossiers of application for labor licenses, then submit them to the leaders of the sections in charge of consideration and decision.

+ After getting the decision of the leaders of the management board, the Labor Management Department shall advise the leadership in charge of signing the work permit. In case of refusal to grant a labor permit, the Labor Management Department shall advise the head of the signatory department in writing the reply and clearly state the reasons therefor.

+ The Labor Management Department shall transfer the work permit or written reply to the request-receiving and result-notifying section.

- Step 3: Individuals and organizations present the appointment letter, pay the fee and receive the results at the one-stop shop (OSS)part of Public Administration Center. Time to return results: Morning from 7:30 to 11:00, afternoon from 14:00 to 16:00, Monday to Friday every week.

1.2. Method of implementation: At the OSS and the Bac Giang Industrial Zones Authority.

1.3. Composition, number of records:

a) Profile composition:

a.1. The employer's written request for work permit according to the regulations of the Ministry of Labor, War Invalids and Social Affairs (according to set form).

a.2. A health certificate or health certificate issued by a competent foreign health agency or organization in Vietnam is valid for 12 months from the date of signing the health claim to the date of submission of the application file. .

a.3. A judicial record or a written certification that the foreign worker is not a criminal offender or subject to criminal prosecution from a foreign country. In case the foreigner residing in Vietnam only need a judicial record issued by Vietnam.

The judicial record or written certification that the foreign worker is not a criminal offender or examined for penal liability shall be issued no more than 6 months from the date of issuance to the date of submission of the file.

a.4. Documentation proving to be the manager, the chief executive, the expert or the technical worker.

a.5. 02 color photos (size 4cm x 6cm, white background, straight face, bare head, no colored glasses), photo taken no more than 06 months prior to the filing date.

a.6. Authenticated copies of passports or valid papers in lieu of passports or valid international travel papers as prescribed by law.

Note:

- The papers specified at Point a.2, Point a.3 and Point a.4 above are one copy enclosed with the original for comparison or one certified copy.

- If the above-said papers are foreign-based, they must be consularly legalized, except for cases where they are exempt from consular legalization under international treaties to which the Socialist Republic of Vietnam and foreign countries are related. 1.4. Processing time: 07 working days from the date of receipt of a complete and valid file.

1.7. Results of implementing administrative procedures: Work permit for foreigners.

1.8. Fees and charges: VND 600,000 per work permit (Resolution of the People's Council of Bac Giang province No. 10/2014 / NQ-HDND dated July 11, 2014 regulating the rates and rates of regulation of fees and charges Bac Giang province).

1.9. Form name, declaration form:

Written request for grant of work permit shall be made according to form No. 7 promulgated together with Circular No. 40/2016 / TT-BLDTBXH.

1.10. Requirements and conditions for implementing administrative procedures:

1.10.1. Foreign workers are specialists, managers, executives and technical workers

a) Experts are foreign laborers falling into one of the following cases:

- Having a document certifying to be an expert of an agency, organization or enterprise in a foreign country;

- Having a university degree or higher or equivalent and having at least 03 years of working experience in a professionally trained profession suitable to the position of the foreign worker expected to work in Vietnam; In special cases, the Prime Minister shall consider and decide.

b) The manager or executive director is a foreign worker falling into one of the following cases:

- Managers are managers of enterprises according to the provisions of Clause 18, Article 4 of the Law on Enterprises or heads or deputy heads of agencies or organizations;

- The executive director shall be the head and direct manager of units attached to agencies, organizations and enterprises.

c) Technical laborers who have been trained in technical or other specialties for at least one year and worked for at least 3 years in the trained specializations.

1.10.2. At least 15 working days from the date the foreign worker intends to commence work for the employer, the employer must submit the application for a work permit to the employer. The authority to issue a work permit.

1.10.3. Employers (except contractors) have the responsibility to determine the need to employ foreign workers for each job position that Vietnamese workers have not yet met and to report to the President of the Commission. The people's committee of the province or city under central authority where the foreign worker intends to work. In the course of implementation, if changing demands for employing foreign laborers, the employers must report such to the presidents of the provincial-level People's Committees

10.4. The Industrial Zones Authority receives reports explaining the need for employing foreign workers for each job position that Vietnamese workers can not meet, summing up and submitting to the Chairman of the Committee. Provincial people decide.

1.11. Legal grounds of administrative procedures:

- Pursuant to the Labor Code dated 18 June 2012.
